RESPA §8 The one rule under all 12

Co-marketing is legal when each party pays the fair market value of what they actually get, split pro-rata. It becomes illegal the moment anything of value is given or received for referrals. When a play is tagged review, run the arrangement past CMS compliance and document the split before you spend a dollar. "Clean" plays are pure education or your own service — no exchange.
